The day before it takes effect, bar owners file last-minute lawsuit to stub out smoking ban.

With just hours to go before Ohio’s new statewide smoking ban goes into effect, a lawsuit has been filed in Cincinnati that could stop the voter approved prohibition from going into effect. The Buckeye Liquor Permit Holders Association is asking for a temporary restraining order. All of this takes anti smoking activist Tracy Sabetta by surprise.

Sabetta says if businesses remove ashtrays, display signs, and ask patrons not to smoke, they are following the Ohio Department of Health’s new rules for the ban. But Pat Carroll, the president of the group filing the lawsuit, says this new smoking ban is unconstitutional.

At this point, the new statewide smoking ban is scheduled to go into effect at 12:01 a.m. Thursday morning.
